Whenever you buy something, it is given a warranty or guarantee by the company or seller. But if the company or seller refuses to give replacement or service, then the consumer court can help you. The rights of consumers are explained in detail in the District Consumer Forum, and various magazines.



There is provisions in the law to ensure that the interests of consumers are not ignored. Every year, 24 December is celebrated as National Consumer Rights Day in our country to make consumers aware of their interests. However, we celebrate March 15 as World Consumer Day. The Consumer Protection Authority monitors the advertisements that misunderstand or mislead. If a company gives false guarantee, do not give service or mislead the consumer by taking quality, quantity etc., then it can be complained. The consumer is also refunded if the complaint is found to be correct.

When you buy a goods or pay money for a service, you are called a consumer. If something or service you have got for free or you have taken that thing to sell it again, then you do not fall into the consumer category. As a consumer, you get 6 rights.

If the price of goods or service is less than Rs 50 lakh, then a complaint can be made in the District Consumer Forum. The District Consumer Forum is established in each district.



If the price of goods or service is less than Rs 2 crore at more than Rs 50 lakh, then it can be complained to the State Commission. The State Commission has usually been formed in the capital of every state.



If the price of goods or service is more than Rs 2 crore, then it can be complained to the National Commission. The National Commission is located in New Delhi.



In the jurisdiction where the seller or service provider does business, the consumer can file his complaint. The consumer can also file a complaint under the jurisdiction of his residence.



The consumer can lodge a complaint individually or through his agent. Along with the prescribed court fees, it can also be sent by registered post. There is no fee for claims up to Rs 5 lakh. There is a fee of Rs 200 for Rs 5 to 10 lakh, Rs 400 for Rs 10 to 20 lakh and Rs 1000 for claims ranging from Rs 20 to 50 lakh. Fees are deposited as postal orders or demand drafts.



Generally, 3 copies of the complaint should be sent. The complaint should usually file a complaint within 2 years of lack of service. If the consumer is not satisfied with the order of a consumer forum, then he can file a complaint in the Higher Commission within 45 days of passing the order.
